The relationship between you and CyberTom VPN is governed by these Terms and Conditions, which pertain to their VPN service operated by Dev LLC. These conditions also control the utilization of and entry into our material (“Content”), programs (“Apps”) and any software given by us (“Software”).

1. Acceptance
By using, downloading, or registering, you agree to adhere to our Terms of Service in a legally binding manner. We do NOT offer a service for carrying out illegal activities. It functions as a privacy tool. You agree to comply with all laws in the jurisdictions from which you originate or to which you terminate.

Those who are ineligible or have been suspended, terminated, or removed from the service cannot access it. You assure that you possess the legal capacity to enter into a contract. By using the Service, you agree to follow these Terms. If you do not agree with any portions of the terms, you cannot use the Service.

2. Modification
Occasionally, we might publish updated terms of service that users are obligated to regularly review for any changes. If there are significant changes, we will try to give a minimum of 30 days’ notice before any new terms become active. We will decide what counts as a material change.

If you keep using our Service after the changes take effect, you agree to follow the updated terms. If you do not consent to the updated terms, kindly refrain from using the Service.

3. Accounts
You promise to keep your user id/password and our system safe from unauthorized access and not to disclose or give out your account to others. You are accountable for any activity happening on our servers with your user id/password login.

You agree to refrain from using the system for spamming, port scanning, searching for open proxies or open relays, sending opt-in emails, unsolicited emails, or any form of mass email, even if sent from a different server. You promise not to engage in any form of attacking any other computer or network while using our service.

Engaging in hacking, distributing viruses, committing fraud, sabotaging networks, participating in phishing, or any other illegal activities may result in suspension or termination. Users are accountable for ensuring their services are securely configured and for any damage resulting from their neglect or exposure of vulnerabilities, whether done intentionally or unintentionally.

4. Privacy Policy
Our systems prioritize your privacy and are designed to collect only the personal information you provide during registration, following the principle of data minimization.

We do NOT retain any records of your VPN sessions, online activity, visited websites, or any actions tied to your VPN link. Furthermore, we do not retain VPN connection logs and timestamps correlating with your incoming and outgoing IP address or session length.

We have condensed our Privacy Policy into a separate document for easy comprehension.

5. Subscriptions / Purchase
We do NOT offer Monthly or Annual Subscription. We ONLY offer a Lifetime Subscription. Once you pay once, you can use our VPN service for the rest of your life. There is NO termination required.

6. Refund Policy
ALL SALES ARE FINAL. CYBERTOM OR DEV LLC DOES NOT OFFER ANY REFUNDS, CANCELLATIONS, OR STORE CREDIT ONCE A PURCHASE IS COMPLETED.

7. License
By following these Terms, you are allowed to download and use the Software with a non-exclusive and restricted license. Any unauthorized modification, distribution, reverse engineering, or usage of the Software not explicitly authorized by us is strictly forbidden.

It is not allowed to use any material that is under our intellectual property rights unless you have received explicit written permission from us.

Unless stated otherwise in this Agreement, both parties are not allowed to assign, encumber, or transfer their rights and duties without the written consent of the other party. The non-assigning party has the option to void any prohibited assignment or transfer.

8. Third-party Websites
The links on our Service may lead to third-party websites or services that we do not own or control. We do not have any control over and do not take responsibility for the content, privacy policies, or practices of any third-party websites or services. You also accept and agree that we are not responsible or liable, whether directly or indirectly, for any harm or loss that may be attributed to the use of, or reliance on, any content, products, or services provided on or through any websites or services. It is highly recommended that you review the terms and conditions as well as the privacy policies of any third-party websites or services that you access.

9. Disclaimer
Service coverage, speed, location, and quality can vary. The service will strive to be accessible 24/7 excluding short periods for maintenance and repairs. Nonetheless, the Service could experience periods where it is unavailable due to factors outside of our control such as emergencies, failures from third party services, transmission issues, equipment or network problems, limitations, interference, signal strength problems, and interruptions, refusals, limitations, or reductions. We are not liable for any loss of data, messages, or pages due to interruptions or performance issues with the Service or communication networks. We have the authority to enforce restrictions on usage, suspend Service, or restrict certain usage to safeguard the service. The speed of the network is only an approximation and does not reflect how quickly the Service transmits or receives data. The network speed you experience may differ depending on settings, compression, traffic, and other variables. There is no surety on the accuracy and timeliness of data received; delays or omissions are possible.

10. Limitation of Liability
Dev LLC, along with its directors, employees, partners, agents, suppliers, sub-contractors, or affiliates, will not be responsible for indirect, incidental, special, consequential, or punitive damages. This includes loss of profits, data, use, goodwill, or other intangible losses from your access to or inability to use the Service, third-party conduct or content, content obtained from the Service, and unauthorized access or alteration of your content. This applies regardless of legal theory or awareness of the potential for damage, even if a remedy fails in its purpose.

11. Governing Law
These Terms will be regulated and interpreted based on the laws of Wyoming, regardless of its conflict of law provisions.

Failing to enforce any right or provision in these Terms does not mean we are giving up those rights. If a court deems any part of these Terms invalid or unenforceable, the rest of the Terms will still be valid. These Terms are the complete agreement between us for our Service, and they take the place of any previous agreements we may have had for the Service.

12. Severability
If any part of this Agreement is not allowed or cannot be enforced in one place, it will not affect the other parts of the Agreement and will still be valid in other places.
